A landmark federal court ruling on the city’s new short-term rental law could come Wednesday, capping two months of limbo that saw the city barred from enforcing the law designed to regulate the controversial industry.
U.S. District Judge Ivan Lemelle of the Eastern District of Louisiana issued a temporary restraining order in August that forced the city to freeze the permitting regime it passed earlier this year. Lemelle said he wanted to weigh the constitutional arguments of STR owners in a long-running lawsuit.
Those plaintiffs convinced the 5th Circuit Court of Appeals to strike down a previous version of the law in 2022, prompting Lemelle to require the city to come up with the new one. The plaintiffs promptly filed a new complaint, leading to the temporary restraining order.
Exasperated members of the City Council have said they are prepared to blow up the industry if the courts strike down the law again.
“If we cannot regulate short-term rentals, then there will be no residential short-term rentals,” Council President JP Morrell said on Oct. 5, referring to STRs in residential areas.
Commercially zoned STRs are not part of the current litigation, although the council is separately weighing new rules for those and has imposed a temporary ban on new applications.
Lemelle had been expected to rule on the latest challenge on September 27, but he said then wanted to hear more arguments related to how short-term rentals affect the city’s housing market. Those arguments are expected to be heard in court on Wednesday.
It is not clear if Lemelle will rule Wednesday, though multiple hearing postponements — most recently from Nov. 2 to Wednesday — have prolonged uncertainty over the controversial industry. Applications for new permits have not been accepted since Lemelle's order on Aug. 31.
“We're in a bit of a no man’s land,” said Ashley Becnel, the city’s chief zoning official who oversees STR permitting.
